Council fined after man died due to health and safety failures
A council has been fined after
health and safety failures led to the death of a pensioner.
Following an investigation into the death of 75-year-old Duncan MacGillivray, Argyll and Bute Council was prosecuted by the Health and Safety Executive (HSE) and pleaded guilty at the resulting court case, at which it was issued with a £20,000 fine.
Mr MacGillivray died after driving off a car park into the sea, where he became trapped in his vehicle and drowned.
He was trying to reverse his car but accidentally drove forwards and over the edge, because of the lack of a protective barrier to prevent such accidents from occurring.
Inspector Mike Orr from the HSE said: "A simple risk assessment would have identified the clear risks of an unprotected sheer drop into the sea at the edge of a car park."
Earlier this year, East Ayrshire Council was fined more than £50,000 after health and safety failures led to the death of Robert McGill, who was an electrician employed by the council.
